Misdiagnosis Handling Complex Cases With Unparalleled Expertise

Misdiagnosis Attorney in Columbus

Building Diagnostic-Error Claims on Nationally Recognized Medical Experts

When a doctor identifies the wrong condition, the consequences can be severe: treatments that cause harm, diseases that advance unchecked, and time that can’t be recovered. Medical misdiagnosis is a recognized form of medical malpractice, and Columbus, Ohio, patients harmed by a diagnostic error have legal options. At Rourke & Blumenthal, we build misdiagnosis claims on a foundation of nationally recognized professionals in medicine, science, and rehabilitation. They provide the kind of standard-of-care testimony these cases specifically require to prove negligence against hospitals and healthcare systems.

Diagnostic errors are distinct from surgical or medication errors. They turn on what a qualified provider in the same specialty should have identified given the available information, and that question demands credible medical authority to answer.

If you or a family member suspects a misdiagnosis caused serious harm, contact Rourke & Blumenthal today for a free consultation. Call (614) 321-3212 to speak with our misdiagnosis attorney about your situation.

Why Columbus Patients Bring Misdiagnosis Claims to Rourke & Blumenthal

With over 150 combined years of legal advocacy, our team understands what it takes to pursue a diagnostic-error claim from investigation through trial. We draw on a network of nationally recognized professionals across medicine, science, and rehabilitation to identify where a provider’s conduct fell short of the accepted standard of care and what that failure cost the patient. These aren’t generic consultants. They are the kind of credentialed voices that carry weight when a claim faces a well-funded hospital or health system.

Clients at Rourke & Blumenthal receive direct, personal attention throughout the process. We take on powerful opponents without hesitation, and we approach each case with the commitment we’d give a member of our own family.

What a Columbus Patient Must Prove in a Misdiagnosis Case

Ohio medical malpractice law generally requires a plaintiff to establish four elements: a doctor-patient relationship existed, the provider failed to meet the accepted standard of care, that failure caused harm, and the patient suffered measurable damages. In a misdiagnosis case, the central question is whether another provider in the same specialty, presented with the same information, would have reached a different diagnosis. That question almost always requires expert testimony to answer.

Ohio Rule of Civil Procedure 10(D)(2) adds a procedural threshold: a medical malpractice complaint must generally include an affidavit of merit, a sworn statement from a qualified medical professional affirming that the claim has a reasonable basis. Our network of recognized professionals allows us to meet that requirement with the right expert for the specific condition and specialty involved.

Ohio Filing Deadlines for Misdiagnosis Claims

Under Ohio Revised Code 2305.113(A), a medical malpractice lawsuit generally must be filed within one year of the malpractice or within one year of when the patient discovered, or reasonably should have discovered, the injury. In misdiagnosis cases, the discovery rule can shift that starting point: the one-year clock may not begin until a patient learns, or reasonably should learn, that an incorrect diagnosis caused their harm. These determinations are fact-specific and vary by case.

Ohio Revised Code 2305.113(C) sets an outer limit of four years from the date of the alleged negligence, regardless of discovery, with narrow exceptions defined by statute. Sending a written notice of intent to sue before the standard one-year deadline expires may extend the filing window by up to 180 days under Ohio law. Lawsuits arising in Columbus are generally filed in the Franklin County Court of Common Pleas for claims above $15,000, which includes virtually all medical malpractice cases.
