Cancer Misdiagnosis Handling Complex Cases With Unparalleled Expertise

Cancer Misdiagnosis Attorney in Columbus

Over $300 Million Recovered. Nationally Recognized Experts. No Fees Unless We Win.

A cancer misdiagnosis occurs when a physician fails to diagnose cancer at all, diagnoses it as a different condition, or diagnoses it so late that treatment options narrow and outcomes worsen. Under Ohio law, that failure can constitute medical malpractice. At Rourke & Blumenthal, we represent Columbus patients and families pursuing these claims, drawing on over 150 combined years of legal advocacy and a network of nationally recognized medical experts whose testimony is central to building a case.

If you believe a delayed or missed cancer diagnosis affected your care, call our Columbus office at (614) 321-3212 for a free consultation. We work on contingency, so there are no upfront fees.

What Ohio Law Requires to Prove a Cancer Misdiagnosis Claim

Ohio medical malpractice claims rest on four elements: a duty of care owed by the physician, a breach of the accepted standard of care, a causal connection between that breach and the patient’s injury, and actual damages. In a cancer misdiagnosis case, the breach element typically turns on whether a physician’s diagnostic decisions fell below what a reasonably competent practitioner would have done under similar circumstances.

Establishing that standard requires expert medical testimony, usually from an oncologist or other cancer specialist familiar with accepted diagnostic protocols. Ohio law also requires an affidavit of merit (a sworn statement from a qualified medical expert confirming the claim has a reasonable basis) before a case can move forward. Our network of nationally recognized experts across oncology and related disciplines helps us meet these requirements and build the medical foundation these claims demand.

Filing Deadlines for Columbus Cancer Misdiagnosis Claims

Ohio’s statute of limitations for medical malpractice is generally one year from the date the malpractice occurred or from the date the patient discovered, or reasonably should have discovered, the injury. Ohio Revised Code Section 2305.113(A) governs this deadline. Missing it typically bars the claim entirely.

A separate deadline applies regardless of discovery. Ohio’s statute of repose under ORC 2305.113(C) generally bars claims filed more than four years after the act or omission, even if the patient learned of the injury later. Two exceptions are worth noting: if the patient was a minor at the time of the malpractice, the one-year period is generally tolled until age 18; and sending written notice of intent to sue before the one-year deadline expires can extend the filing window by 180 days. These rules carry narrow exceptions and interact in ways that can affect a specific case, so speaking with a cancer misdiagnosis attorney as early as possible matters.

Where Columbus & Franklin County Malpractice Claims Are Filed

Most cancer misdiagnosis claims in the Columbus area are filed in the Franklin County Court of Common Pleas General Division, which hears civil matters where the amount in dispute exceeds $15,000. Its jurisdiction covers Franklin County cities including Columbus and Dublin, Ohio. Major health systems in the area, including OhioHealth, Mount Carmel Health System, The Ohio State University Wexner Medical Center, and Nationwide Children’s Hospital, appear regularly in area malpractice litigation given the volume and complexity of cancer-related care they provide. Knowing how these institutions and this court operate is part of how we prepare each case.

Why Clients Choose Rourke & Blumenthal for Cancer Misdiagnosis Claims

Cancer misdiagnosis cases are medically and legally complex. They require physicians who can speak to diagnostic standards, pathologists who can address how results should have been read, and attorneys who understand how to translate that testimony into a coherent legal claim. We’ve built our medical malpractice practice around exactly this kind of multi-disciplinary work, recovering over $300 million for clients across these cases.

We take on hospitals, health systems, and other large institutions as fearless advocates for individual clients. Clients receive direct attention throughout the process, not a case number passed between staff. That’s how we operate, and it’s why clients trust us with some of the most difficult circumstances they’ll ever face.
