Uber & Lyft Accident Lawyer in Columbus
Direct Attorney Access. $300 Million Recovered for Injury Clients.
Rideshare accidents don’t work like ordinary car crashes. Uber and Lyft operate through layered insurance systems that shift depending on what the driver was doing at the moment of impact. Untangling those layers takes a firm that knows how transportation network companies and their insurers operate. At Rourke & Blumenthal, we represent people injured in Uber and Lyft accidents throughout Columbus, Central Ohio, and across Ohio, bringing over 150 combined years of legal experience and a network of nationally recognized experts to every case.
If you were hurt in a rideshare accident, don’t wait to get answers. Call our attorneys at (614) 321-3212 for a free consultation.
What Sets Rourke & Blumenthal Apart in Rideshare Cases
When you call us, you speak with an attorney. Not a paralegal, not a legal assistant. A lawyer who can evaluate your claim, explain your options, and begin building your case from the first conversation. That’s not how every firm operates, and we think it matters.
Our attorneys are AV Rated by Martindale-Hubbell and members of the Million Dollar Advocates Forum, a distinction limited to attorneys who have obtained million-dollar or multi-million-dollar results for clients. Across our personal injury practice, we’ve recovered more than $300 million in verdicts and settlements. Uber and Lyft are large corporations backed by well-resourced insurers. We have the standing and the resources to take them on.
How Ohio’s Rideshare Insurance Law Applies to Your Crash
Ohio Revised Code 3942.02 establishes three distinct insurance periods for rideshare drivers, and which period applies at the moment of your crash determines which policy covers your injuries.
The three coverage periods under Ohio law:
- App off: The rideshare company’s insurance doesn’t apply. Only the driver’s personal auto policy is relevant.
- App on, waiting for a match: Ohio law requires at least $50,000 per person and $100,000 per accident in bodily injury coverage, plus $25,000 in property damage.
- Ride accepted through drop-off: The rideshare company’s policy must provide at least $1 million in liability coverage.
Because rideshare drivers are classified as independent contractors rather than employees, the companies often dispute their obligations when a crash occurs. The driver’s app status at the exact moment of impact, typically established through trip and GPS records, is usually the central factual question in these claims. We know how to obtain and interpret that data.
Who Can Bring a Rideshare Accident Claim in Columbus
Your role in the accident affects which insurance policies are available to you. A passenger in an Uber or Lyft may have a direct claim against the rideshare company’s $1 million liability policy. An occupant of another vehicle may be dealing with the at-fault driver’s personal insurer, the rideshare company’s policy, or both. Pedestrians and cyclists injured by a rideshare vehicle face similar paths. In some cases, a victim’s own uninsured or underinsured motorist coverage fills gaps the other policies don’t.
Rideshare drivers themselves can also be injured by third-party drivers. No matter your role in the collision, we can assess which coverage applies and the damages you may be able to pursue, including economic damages like medical bills and lost wages and non-economic damages like pain and suffering.
