Our Columbus birth injury attorneys at Rourke & Blumenthal are proud
to announce that we have successfully obtained a
significant settlement for a young child and the child’s parents in a
birth injury lawsuit filed against The Ohio State University Medical Center. We were retained
by the parents of the young child to investigate whether or not the medical
care received by the child’s mother during the pregnancy was reasonable
under the circumstance. If not, we also needed to determine whether the
severe neurological problems that the child suffered at birth would have
likely been preventable with proper medical care.
To begin our work, Rourke & Blumenthal and our highly experienced team
of personal injury lawyers in Columbus conducted an extensive investigation,
which included consultation with multiple medical experts from a variety
of medical specialties. Based on this investigation,
Attorneys Mike Rourke and
Tim Mahler determined that this child’s severe injuries would have likely been
entirely prevented with acceptable standards of medical care. Specifically,
we found that the OBGYN who treated our client the day before the delivery
for concerns of elevated maternal blood pressure did not perform an adequate
fetal well-being evaluation. Had a proper fetal well-being evaluation
been performed, we believe that it would have identified significant problems
with the pregnancy, leading to the admission of the mother and a more
timely delivery. The delayed delivery caused the fetus to suffer prolonged
oxygen deprivation, which lead to bleeding in the baby’s brain and
permanent neurological injury.
Birth injury cases are very complicated and often involve many medical
experts from various specialties, such as obstetricians, pathologists,
neurologists and others. Indeed, this case involved over twenty medical
experts from all over the country. After prolonged and expensive litigation,
Rourke & Blumenthal was able to achieve a significant settlement for
this child. The settlement will help this child and his family with the
costs of the many medical needs that he will have in the future, near and far.
